Contract terms

This is a translation, provided so that it can be read. The is the binding one: the consumer provisions behind them apply to a German operator, and where the two differ the German text is what holds.

One garden is free, for as long as you want it. A paid year is bought at the garden it is for: signed in, on that garden’s own page.

1. Who is contracting with whom

Terrana is provided by Jakob Maximilian Pelz, Olenhoffweg 1a, 21614 Buxtehude, Deutschland, email info@terrana.garden. The full details are in the Impressum.

For a free account, the provider is your contracting party. To buy a paid year, Paddle is brought in and acts as the seller itself (a merchant of record). It is then your contracting party for the purchase and for billing, and sends you the invoice and receipts; the service itself is still provided by the provider above.

2. What Terrana does

Terrana is a web service. You draw your garden once. From that it computes how many hours of direct sun reach individual spots, keeps a record of your plants with their positions and their history, and writes a care plan from it.

There is nothing to install. You need a current browser and an internet connection.

3. The free account

One garden is free, with no deadline and no payment details. What it includes is on the pricing page. Neither we nor the merchant of record ask for a payment method for the free account.

The free account does not expire and does not turn into a paid one. A paid year begins only if you explicitly buy it.

4. The paid year: term, renewal, cancellation

A free account is not a contract that renews and does not need cancelling. If you no longer want it, you delete it (§9).

5. Prices and payment

Prices are on the pricing page. The amounts stated there for Germany are total prices. The amount that applies in your country is shown by the merchant of record at checkout, before you confirm anything.

The tier follows the area of your garden as it comes out of your drawing. It is therefore settled before anything is computed, and does not change because you log more plants. You are not billed by the number of plants.

Payment is for one year in advance.

6. Withdrawal and money back

As a consumer you have a fourteen-day right of withdrawal. How to exercise it and what happens then is in the withdrawal notice, together with the model withdrawal form. Signed in, it is also one click: through Withdraw from contract, at the foot of the page and under Account, for as long as the fourteen days run.

Beyond that, voluntarily and independently of it: if you write within fourteen days of the purchase to say you do not want the year, we refund the full amount. No deduction for the time already run, and no reason needed. This applies to buying a year, not to its renewal. This does not limit your statutory rights.

The money comes back from the merchant of record, to the payment method you paid with. The paid year ends with the refund; your garden continues for free.

7. What the numbers mean, and what they are not

Terrana computes sun hours from geodata, from official surveys where they exist, and from what you tell us yourself. How precise the basis is for a given address depends on what data exists for it, and is stated next to every number. A computed sun-hour figure is a calculation on a model of the terrain, not a measurement taken at your bed.

Care advice rests on species knowledge applied to your site. It is a reasoned suggestion and not an assurance that a plant will establish, survive or flower. You know more about your garden than we do: what you tell us we take as given, and we do not verify it.

That is a description of what you get, not a limitation of liability. We are liable for damages under the applicable statutory rules.

8. Availability and changes

Terrana is under continuous development. Individual parts are marked still being built where they do not exist yet. Maintenance, faults and outages at the hosting provider can make the service temporarily unreachable.

If we remove something during a paid year that was promised for that year, we tell you by email beforehand. You can then cancel as of the date of the change and get back the share of the year not yet used.

9. Ending the account and deleting data

You can delete at any time and with no reason. A single garden you delete on its own page: it disappears at once, you can bring it back for 30 days, and after that it is deleted for good. Your whole account with every garden in it you delete under Account; that happens at once and cannot be undone. Everything belonging to a garden goes: the address, the drawing, the plants, the photographs, the share links.

If a paid year is running for a garden, it no longer renews from the moment you delete it. When the garden is deleted for good, with the account or after the 30 days, the year ends with it, with no refund for the rest of the term. In the fourteen days after buying you can withdraw first (§6).

10. Applicable law

German law applies. If you are a consumer habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.
